General conditions of sale and booking conditions of the guesthouse

Art. 1 Scope of validity

These General Conditions govern the booking and/or purchase of stays and/or packages (hereinafter "services") by customers/consumers made remotely, with a request via email, by telephone or via the electronic network on the website www. .romecookseaguesthouse.com by Romecooksea Guesthouse by Mirko Lausi, with registered office in Via Pietro Ercole Visconti 38, 00121 ROME (RM) - VAT number 15550941007.

These General Conditions of Sale, available online at the time of booking on the website www.romecookseaguesthouse.com, are made available to customers/consumers who can print them or save them in digital format on their computer's memory. Customers/consumers should examine these General Conditions carefully before proceeding with booking and/or purchasing services on the Romecooksea Guesthouse website. In any case, before completing the electronic procedure for forwarding the purchase order, these General Conditions are shown to the customer/consumer, and the latter must proceed with their full and unconditional acceptance by placing a check in the dedicated box to be able to proceed with the purchase.

Purchase orders received by Romecooksea Guesthouse, via email, by telephone or placed online via the homepage www.romecookseaguesthouse.com, are governed exclusively by the following general contract conditions in the form valid at the time of the order.

Art. 2 Conclusion of the contract and right of withdrawal

The order sent via the Romecooksea Guesthouse website by the customer/consumer is a contractual offer that Romecooksea Guesthouse di Mirko Lausi reserves the right to accept.

The prices published on the website at the time of ordering will be applied, to be carried out using the appropriate online order form, by email or by telephone.

When sending the order through the site's IT interface, the customer/consumer will be required to press a virtual button which will certify that the customer/consumer has acknowledged that the sending of the order and its subsequent acceptance by part of Romecooksea Guesthouse will incur a fee.

The contract between Romecooksea Guesthouse and the customer/consumer is concluded with written confirmation (or automatic response from the site) by Romecooksea Guesthouse, summarizing the customer's purchase proposal, to the email address indicated by the customer/consumer at time of sending the order; this email communication will perform the function of acceptance of the order sent by the customer/consumer.

The customer/consumer acknowledges that the contract has as its object the provision of services relating to free time such as, by way of example but not limited to, hotel stays, for which Romecooksea Guesthouse undertakes to provide them on a date or in a specific execution period and, therefore, THE RIGHT OF WITHDRAWAL provided for by the art. 52 of the Consumer Code, according to art. 59 paragraph 1 letter. n) of the code itself; Pursuant to Article 16 of Directive 2011/83/EU of the European Parliament, the right of withdrawal within 14 days does not apply to hotel and non-hotel reservations.

Art. 3 Conditions and methods of payment

The purchase price becomes due with confirmation of the order. The prices in force at the time of the order will be applied.

Payment must be made by credit card or cash. Romecooksea Guesthouse accepts Visa and MasterCard. The credit card data will be provided together with the order, directly on the web page. The data will be transmitted directly to our server, via a secure connection (128-bit SSL encryption). As soon as the transaction is executed, the data will be automatically deleted from the server. In this way we can guarantee maximum safety. In the case of reservations and/or purchases made by telephone, a confirmation email will be sent with the link of the bank to connect to to make the payment by credit card. Of course, you can also communicate your credit card details by telephone.

At the explicit request of the customer/consumer, it can also be done by bank transfer, in which case the payment terms will be agreed between the parties.

Only confirmation of the order, after verification of payment, by Romecooksea Guesthouse gives rise to the right to use the service purchased.

Art. 4 Deposit and cancellation policies

Each rate, package and/or service has its own deposit and cancellation policy indicated. Customers/consumers should carefully examine the deposit and cancellation policies present in each rate and/or package before proceeding with booking and/or purchasing services on the Romecooksea Guesthouse website.

Acceptance by placing a check in the dedicated box before proceeding with the purchase confirms acceptance of the conditions indicated in the relevant deposit and cancellation policies.

Art. 5 Use of the services booked and/or purchased

To use the services purchased, it is necessary to deliver the confirmation received from Romecooksea Guesthouse together with the identity documents of all residents to the reception of the facility upon arrival at the hotel.

The provision of services will take place only after the presentation of this confirmation.

No refund will be due for unused services and/or for early departures and/or for a decrease in the components included in the booking and/or purchase of services.

Art. 6 Guarantee and responsibility

The correspondence between the images published on the website www.romecookseaguesthouse.com and their actual appearance may differ.

Romecooksea Guesthouse is responsible for damage caused by the use of the services, exclusively if such damage occurs despite compliance with the indications and instructions for use.

Art. 7 Data protection

Pursuant to and effects of the art. 13 of Legislative Decree 196/03 (Privacy Code), and of EU Regulation no. 679/2016 (GDPR), the customer/consumer declares to have been informed about the methods of data processing and its purpose, as well as regarding their rights established by art. 7 of Legislative Decree 196/03 and subsequent amendments. By clicking on the icon at the bottom of the general contract conditions, the customer declares to have received and taken note of the above information and agrees, pursuant to art. 23, to the processing of their data for the purposes described above.

In all transactions, your data will be encrypted using Secure Socket Layers, the SSL encryption system.

Art. 8 Applicable law and exclusive jurisdiction

The exclusively competent court is the Court of Rome. Contractual relationships will be governed exclusively by Italian law.

Art. 9 Room preparation, room delivery, room return

The customer does not acquire any rights relating to the preparation of the fixed room

The booked room is available to the customer starting from 2.00 pm on the agreed day of arrival. The customer has no right to have the room ready in advance.

On the agreed departure day the room must be vacated by 10.30 am at the latest. Otherwise, the hotel will charge 100% of the room price for use of the room after 10.30 am.

Each Guest is required to safeguard, in his own interest, the things he owns. THE MANAGEMENT IS NOT RESPONSIBLE IN ANY CASE FOR ANY THEFT, DEFENCES AND DAMAGES OF ANY KIND CAUSED TO VEHICLES AND OTHERS.
